In conjunction with the world’s tremendous development in the field of communication, and digital data transfer technology, and what has been produced by modern technologies, has cast a shadow over all sectors of life represented in general the commercial sector, economic, financial and in particular the contracts that are concluded permanently, but the greatest effect observed for this revolution was the share of smart phones that have become the focus of the world and the use of companies many of the modern systems, such as ISO system and the Android system, where the function of these phones not only limited to the communication as it was in the past, but exceeded to be browse the Internet by telephone and not as in the traditional way through computers, Therefore, the phones are a real necessity to all developing societies and advanced they can browse all the various websites in all social fields through communication through social sites and also in business. However, it is noticeable that there is a hidden adhesion contract between the user of smart devices and the service provider, for example ( Google ) cannot use the smartphone or any smart application without making account with provider companys , taking into consideration that the smart phone in this stage is very important and necessary things in our daily life, in addition the provider sets contract terms and moreover the reality that the provider monopoly of the contract , based on that we must be recognized the existence of hidden electronic adhesion contract through smart phones.
